1. The Agreement
1.1 Destination Åland, Östra Esplanadgatan 7, AX-22100 Mariehamn, is responsible towards the Traveller for what the Traveller has the right to demand as a result of this Agreement. The responsibility also includes performances done by others than Destination Åland.
1.2. The information given on this page is binding for Destination Åland. However, Destination Åland owns the right to alter the information on this page, before the Agreement has been made.
1.3. Destination Åland has to keep the Traveller informed about questions significant to the Traveller and relating to the Agreement.
1.4. When the reservation includes both travel and accommodation, the “Departure” in the Agreement will consider the date and time when the travel according to the reservation is starting. When the reservation only includes accommodation, the “Departure” will consider the date of arrival to the place of accommodation in question.
1.5. The Agreement is binding for both parts, when Destination Åland has confirmed in writing the Traveller’s order and the Traveller has paid the agreed reservation fee within the agreed time according to the instructions of Destination Åland.
Destination Åland will confirm the Traveller’s order without any delay.
The Agreement can be binding for the Traveller, even if the reservation fee has not been paid, for example when making reservations by phone.
2. Payment of the travel
2.1. The reservation is confirmed, when the client has paid the reservation fee (part payment counted on 25% of the total cost) on the due date the latest, or has paid the total sum at the same time, when making a late reservation. The total cost of a reservation is carged on creditcard when a reservation is made online.
2.2. The final payment of the travel should be done the latest 42 days before Departure or at the same time as the reservation is done, if this occurs later than 42 days before Departure.
2.3 No handling or extra charges will be added on online bookings.
2.4 For bookings made through our call center or at the Destination Åland office a charge of 10 euros will be added on the booking.
2.5 Should the client fail to pay within set dates, Destination Åland will cancel the client’s booking without further notification.
2.6 In case of obvious false pricing on the online booking engine Destination Åland has the right to cancel the booking. The client has to be informed thereof within 60 hours from when the booking was confirmed.
3. The Travellers right to cancel the travel
3.1. The Traveller has the right to cancel the travel according to the following: - the cancellation fee is always 10 € per reservation.
3.1.1. When cancellation of cottage is made later than 42 days before Departure, the Traveller will have to pay the total sum of the reservation. When cancellation of hotel room is made later than 1-7 days before Departure, the Traveller will have to pay the total sum of the reservation. 3.2.2. Cancellation can be made if the Traveller, or the spouse of the Traveller, or a close relative of the Traveller or of the spouse of the Traveller, or the person, with whom the Traveller has made the reservation, before the Departure, but after the Agreement has become cogent according to 1.4, will suffer from a serious illness, a deteriorating state of ill-health or accident and if this accident is of a kind that the Traveller cannot reasonably make the travel.
3.2.3. Cancellation can be done if another accident affects the Traveller, after that the Agreement has become cogent according to 1.5. and if the accident is of that intervening character for the Traveller, that it is not reasonable to demand that the Traveller should carry out the travel. The Traveller should not have been able to prevail this accident nor known or could have been able to know this, when the reservation was being made. Such an accident could for example be fire in the Traveller’s home.
3.2.4. Cancellation can be made, if a person, with whom the Traveller has made the reservation, will cancel the reservation by virtue of 3.2.2, or 3.2.3, and it is unreasonable that the Traveller should go through with the travel without the company of this person.
3.2.5. The Traveller that has made a reservation for accommodation together with a person, who has cancelled the travel by virtue of 3.2.2-3.2.4 shall pay the amendment that according to the price list is charged for accommodation with a higher standard, for example single room instead of double room.
3.2.6. The Traveller shall cancel the reservation as soon as possible after that the reason for the cancellation has occurred. The reason for the cancellation shall be proven in a reliable way by doctor’s certificate, a certificate of relationship or police report.
3.3 Cancellation shall be done in writing and immediately to Destination Åland or to the travel agency where the reservation is made, by e-mail, fax or mail. The cancellation is made as soon as Destination Åland has received the information.
3.4. After the cancellation, the balance will be refunded without delay in favour of the Traveller. This, however, is only done if an approven doctor’s certificate has been presented for Destination Åland.
4. Change of reservation
4.1. If the Traveller wishes to change a confirmed reservation, a changing fee of €20 will be added.
4.2. A change of a confirmed reservation can only be made, as long as admitted by Destination Åland. If the reservation is changed so that the Departure occurs later than the Departure of the original reservation, the same cancellation conditions will apply as for the original reservation.
5. The Traveller’s right to transfer the Agreement
5.1. The Traveller has the right to transfer the Agreement to another person, fulfilling all the conditions for participating the travel. The Traveller has to in due time before the travel inform Destination Åland or the travel agency thereof.
5.2. When the Agreement is transferred, the transferrer and the acquirer are equitably responsible towards Destination Åland for what remains to be paid for the travel and for any extra costs, however at the most € 20,-, that will occur because of the transfer.
6. Amendments made by the organizer before the Departure and cancellation of the travel
6.1. Destination Åland is allowed to change the conditions of the Agreement to the disadvantage for the Traveller. The price can be raised owing to changes in the exchange rates, misprint or price rise by Destination Åland’s the suppliers. See also 6.5.
6.2. The Traveller’s right to waive the Agreement.
The Traveller has the right to waive the Agreement, if Destination Åland declares that they will not be able to fulfil their commitments and if the Agreement is of essential significance for the Traveller. The Traveller has also the right to waive the Agreement if the conditions of the Agreement are substantially changed to his disadvantage. If Destination Åland is going to break the Agreement, or wishes to change the conditions of the Agreement, Destination Åland will immediately inform the Traveller thereof and at the same time inform the Traveller of the right to waive the Agreement. The Traveller shall within reasonable time inform Destination Åland or the travel agent if he wishes to waive the Agreement. If he does not do this, he will loose his right to waive the Agreement.
6.3. The Traveller’s right to substitute journey
If the Traveller waives the Agreement according to 6.2, he has the right to another journey equivalent or of higher quality, if Destination Åland can offer this. If the Traveller accepts a substitute journey less worth, the difference in price will be refunded to the Traveller. If the Traveller relinquish from his right to a substitute journey, or, if such cannot be offered, the Traveller should get refunded the sum he has paid, according to the Agreement.
The conditions in the first and second paragraph are also valid in that case that Destination Åland will cancel the travel, without the Traveller being the cause of this.
6.4. The Traveller’s right to compensation
The cancellation of the travel by Destination Åland regarding cases mentioned in 6.3. will give the Traveller the right to compensation, if legitimate.
The right to compensation caused by Destination Åland cancelling the travel will not exist, if Destination Åland can show that the cancellation of the travel is caused by a hindrance out of the control of Destination Åland. This hindrance should be of such character, that Destination Åland had no way of knowing it at the time of making the Agreement. The reason should not be such that Destination Åland could have avoided it or overcome it. If the reason being that someone that Destination Åland has engaged is the cause of the cancellation, then Destination Åland is free from the compensation responsibility according the above, only if the person Destination Åland has engaged should have been free from responsibility according to the above. The same applies if the cause relates to someone else at an earlier stage.
6.5. Change of the price
If price increases occurs for Destination Åland, after that the Agreement has according to 1.4. become binding for both parts, Destination Åland is allowed to increase the price of the travel with an amount that correspond to the increase of the costs, if these depend on:
1. changes in costs of transport
2. changes in taxes, customs or other fees regarding services included in the travel, or
3. any changes in the currency exchange, that will affect the costs the operator has for this travel. The right to increase the price according to 1 and 3 above, only applies if the increase in cost is over € 7. The price cannot be increased the last 20 days before the agreed date of travel. The organizer shall as soon as possible inform the Traveller about the price increase.
6.6. The organizer’s and the Traveller’s right to waive the Agreement at intervening occurrences Destination Åland as well as the Traveller has both the right to waive the Agreement, if it, after that the Agreement has been binding for both the parts according to 1.4, on or nearby the destination of the travel or along the planned route of the travel, a catastrophe, act of war, general strike or other intervening occurrences happens, that significally affects the possibility to do the travel or the conditions at the destination the time when the travel should be made. In order to decide if the occurrence is of such serious character as above mentioned, competent authorities should be contacted.
7. Changes made by Destination Åland after Departure, faults and shortcomings
7.1. Achievements not fulfilled
Destination Åland shall, if after the Departure a significant part of the agreed services not can be presented, arrange for suitable arrangements of compensation without any extra charge for the Traveller. Destination Åland shall, if reasonable, however, if no arrangements of compensation can be arranged or, if the Traveller turns down such arrangements on reasonable grounds, without extra charges for the Traveller, offer equivalent transport back to the place for Departure or to another destination approved of the Traveller. If a change in the Agreement according to the first or second part leads to a deterioration for the Traveller, the Traveller is, if reasonable, entitled to price discount and compensation.
7.2. Other faults and shortcomings
When other faults than the ones mentioned in 6.1. in the agreed services occurs, the Traveller has right to price-discount and compensation, if the fault does not depend on him. The Traveller has no right to compensation, if Destination Åland can show that the fault depends on a obstruction outside the control of Destination Åland, that Destination Åland could not have foreseen when the Agreement was made and which consequences Destination Åland could not have avoided or overcome. If the fault depends on someone that Destination Åland has engaged, then Destination Åland is free from the responsibility for compensation according to the second part only if the one Destination Åland has engaged should be free according to that condition. The same is if the fault depends on someone at an earlier stage. When faults have occurred according to the second or third part, then Destination Åland should give the Traveller the help needed.
7.3. The extent of the damage
Apart from compensation for wealth, damages according to these conditions includes also compensation for damage on person or object.
Damages that are included in the rules in the laws of sea and air transport are compensated according to the law instead of these conditions. The Traveller is under obligation to limit the damage as far as possible.
8. Complaints and corrections
8.1. The Traveller is not to refer to fault, in what he thinks he has the right to demand according to the Agreement, if he has not within reasonable time after he has noticed or should have noticed the fault, informed Destination Åland or the travel agency thereof. This should be done at the destination, for example directly at the hotel, or to the landlord.
8.2. Without any obstruction of 8.1. the Traveller is allowed to refer to faults, if Destination Åland or the travel agency has acted carelessly or in opposition to belief and honour.
8.3. If the Traveller presents complaints that are not unjustified, the Destination Åland or for example the landlord or the hotel shall immediately take action to find a suitable solution.
9. The Traveller’s responsibility during the journey
9.1. Destination Åland’s directions etc. The Traveller is obligated to respect the rules that apply for the journey, the transport, the hotel, the cottages etc and he shall behave so that fellow passengers or others not are disturbed. If the Traveller substantially breaks these rules, the organizer has the right to waive the Agreement.
9.2. The Traveller’s responsibility for damage
The Traveller is responsible for any damage he causes the organizer through negligence, for example by not following the given instructions or rules. The Traveller is under the obligation to compensate for any damage that is legally based towards anyone engaged by Destionation Åland to contribute to the realization of the journey.
9.3. Passports, visas, health regulations
The citizens of the Northern countries have freedom from passports within the Northern countries. Citizens of other countries and stateless citizens are recommended to investigate the rules of passport and visa for entering Finland before accepting the Agreement. The Traveller is himself responsible for observing necessary formalities for realization of the journey, for example holding a valid passport, visa, vaccinations and insurance. The Traveller himself is responsible for all costs that have arisen owing to the shortcomings in the mentioned formalities, for example transport home because of lacking passport.
9.4. Diverging from the arrangement
The Traveller is obligated to inform Destination Åland or the hotel or landlord if he after that the journey has started will diverge from the arrangement.
10. Solving a dispute and application of the law
Finnish law shall be applied on this Agreement.
The parts has to try and solve the dispute concerning the interpretation or application of the Agreement through negotiations. If the parts cannot agree; Ålands Tingsrätt is to try the disput.
